A decision has been made that the flash glucose meter, Freestyle Libre, will be introduced for the treatment and follow-up of children (until they are 18 years) with diabetes type 1 and other types of diabetes in Norway. The Contracting Authority is not aware of any other relevant suppliers or other flash glucose meters in the EEA area than Abbott Norge and FreeStyle Libre. 40000000.00 The procurement will be made as a procurement without a competition, by a contract being negotiated with Abbott Norge for the delivery of FreeStyle Libre to the health trusts. This is in accordance with the Public Procurements Act dated 17.6.2016, no. 73 (LOA) and the Public Procurement Regulations dated 12.8.2016, no. 964 (FOA) part III and § 13-4, letter b. According to the FOA § 13-4, letter b, a procurement can be made without a competition if the procurement is for services that only one specific supplier can provide as competition is impossible due to technical reasons, or to the supplier having a monopoly. The contract with Abbott Norge for FreeStyle Libre will be valid for 1 year, with an option for an extension for 2 times 6 months. According to the FOA § 13-4, letter b, a procurement can be made without a competition if the procurement is for services that only one specific supplier can provide as competition is impossible due to technical reasons, or to the supplier having a monopoly. The Contracting Authority is not aware of any other relevant suppliers in the EEA area of flash glucose meters (FGM). The terms on technical reasons are, as a starting point, difficult to document. The market is, however, clear for this type of medical equipment due to regulatory reasons. It takes a long time to get a product certified and there are few suppliers. FGM can be defined as a new method and FGM can currently only be delivered by one supplier.
