Contracting Authority The Contracting Authority for this contract is Møre og Romsdal fylkeskommune [County], c/o Kristiansund Vocational College. 2. The procurement/contract objective and scope. The Contracting Authority wants to enter into a contract for the upgrading of a K-Sim Engine Desktop simulator with K-Sim Engine High Voltage Breaker with interface to the existing desktop simulator. The machine simulator currently consists of one (1) instructor station and 10 desktop student stations. The Vocational College wants to upgrade the existing simulator with a K-Sim Engine High Voltage Breaker that shall interact with the desktop simulator. The details of the delivery are as follows: — 1 x Real High Voltage Breaker with interface to customers existing engine room simulator, — 1 x 65’’ Monitor with touch overlay, — HW computer, — Sound system, — Packing and Shipment, — Installation. 3. Grounds for omission of competition. 3.1 General This procurement is planned to be carried out as a direct procurement as the Contracting Authority believes that there are legal grounds in this procurement to not hold a tender competition, cf. PPR §8-18 and PPR §5-2, (1) a. Kongsberg Digital AS has sole rights to source code and sole rights to commercial sale of software developed for K-Sim Engine. Kristiansund Vocational College (fik), has investigated if there are other potential tenderers. There is only one service provider in the market who delivers upgrading/expansion of Kongsberg K-Sim Engine Simulators. The upgrading/expansion of the K-Sim Engine, delivered by Kongsberg, can only be delivered by the same supplier. The provision for signing a contract is thereby considered to be met. 3.2 Contract The Contracting Authority intends to sign a contract for approx. 939 000 NOK excluding VAT, with Kongsberg Digital AS in connection with the upgrading of the existing simulator with a K-Sim Engine High Voltage Breaker, that shall interact with the desktop simulator. Kongsberg Digital AS has sole rights to source code and sole rights to commercial sale of software developed for K-Sim Engine.
