The Aarhus 2017 Foundation has decided to contract for works, supplies and services for the two European Capital of Culture 2017 closing events to be held on the 9.12.2017 in Denmark. The two events are to be held at different times during this day and at two separate locations: Hvide Sande in the western part of Jutland (works, supplies and services) and Aarhus in the eastern part Jutland (only services). 2000500.00 Hvide Sande in western Jutland, Denmark, and Aarhus in eastern Jutland, Denmark. Hvide Sande event: Services, supplies and works for a one day cultural ceremonial event. Lighting, sound, safety personel and production personel services for a total amount of 648 500 DKK. Rehearsal, vehicles/car hire/transport, catering, production office, radio communications, plant, production and accommodation supplies for a total amount of 228 000 DKK. Power, toilets and site works for a total amount of 144 000 DKK: Aarhus event: Services, supplies and works for a one day cultural festive event. Special effects, lighting, safety personel services for a total amount of 980 000 DKK (all amounts are ex VAT). European Capital of Culture 2017. The Aarhus 2017 Foundation has decided to contract for works, supplies and services to be able to create two European Capital of Culture 2017 closing events to be held on the 9.12.2017 in Denmark. The two events are to be held at different times during this day and at two separate locations: Hvide Sande in the western part of Jutland and Aarhus in the eastern part. The Aarhus 2017 Foundation has assessed that the contract values of the two events are not to be accumulated in relation to the thresholds of Directive 2014/24/EC and the Danish Act on Public Procurement. This conclusion is based on an overall assessment of the facts of the case relevant to the criteria in relation in the assessment of contract value accumulation, cf. EU Court of Justice case law and the Danish review body case law. The main conclusion is that there is to a certain degree timely continuity between the two events but that the ‘functional continuity’ requirement is not fulfilled. The main arguments behind the conclusion are the following: i) it is not the purpose of the contracts to secure mutual performance of the two events, i.e. the events can be performed independently from each other and one event can be cancelled without affecting the other, ii) the events are to be held at two geographically different locations with a not insignificant distance, iii) the two production teams behind each of the events are not the same.
