This is justified as follows: A reform of the entire toll money sector in Norway is currently being carried out, including the establishment of a supplier of the main system to replace the Norwegian public roads administration´s central system. Furthermore, after the adoption of the issuer regulations, the regional toll money companies are to split their toll money activities. The result of these processes will only be apparent in the first half of 2019, so Fjellinjen is not currently in a position to determine the parameters that tenderers of the invoice distribution service require. Fjellinjen´s future needs cannot be described and they cannot, thus, form the basis for a fair competition. This is due to unforeseen circumstances outside Fjellinjen´s control. It was also not possible to take these unforeseen circumstances into consideration when the competition that lead to the current contract was held in 2014. When the competition was being prepared, a decision had not been made/it was not clear that the toll money sector in Norway would be reformed, that the contract would have to allow for a length that fitted this or the rule changes that affect Fjellinjen´s activities. The announcement of a 'temporary' competition for invoice distribution is seen as socio-economically disadvantageous and bad tender practice. Any temporary competition would mean that a new supplier would have to carry out a partly comprehensive integration process with the old branch and support systems. 6 months after this supplier´s commissioning, Fjellinjen´s organisation would have to start a competition for a new invoice distribution supplier for the new branch system that was designed and partly manufactured over the new year. There will then be a migration/conversion from the current databases and registers. The total time that is available for these 2 supplier hand overs within an 18 month period would be demanding and would necessitate clear sanctions from the customer´s side. The reality is that only the current supplier would be able to submit a tender for the period from September 2018 to the new contract based on the new prerequisites is in place in 2020. Based on this and pursuant to the public procurement regulations § 28-1 letter d, Fjellinjen is extending the current contract with Edigard AS. A competition for a new contract for invoice distribution, based on new toll money systems with new descriptions/requirements, will be announced in late summer 2019.
