The procured apparatuses are partial replacements for equipment procured from GE in a former regular procurement process (MTU/2014/PROJECT 000727/Mammografiapparatur for the Breast Diagnostic Centre in Bergen). The need for the replacements is caused by the tomosynthesis-study conducted by Helse Bergen (the TOBE-study), which is based on GE screening apparatuses. The study is technically dependent on further use of GE products. The contract is dependant on the funding from the Cancer Association/Research Council of Norway for the continuation of the study. This VEAT notice is in accordance with the Norwegian Public Procurement Regulation § 21-5 jfr. § 13-4. The need for the replacements are the ergonomical weaknesses of the existing machines, which has led to health issues among the users due to the extensive use of the machines in relation to the TOBE-study. Helse Bergen is procuring mammography equipment using digital breast tomosynthesis (DBT) to display synthetic mammograms. The equipment will be utilised in the continuation of the tomosynthesis-study conducted by Helse Bergen (the TOBE research study), which is based on GE screening apparatuses. To continue the study it is necessary to use GE screening apparatuses, as identical pipe- and detector technology is a prerequisite to obtaining relevant research data relevant. The contract contains a reservation regarding the funding for the study by the Cancer Association Research Council of Norway. The need for the replacement screening machines are the ergonomic weaknesses of the existing machines, which has led to health issues among the users due to the extensive use of the machines in relation to the TOBE-study. It is not defensible to continue the study using the existing machines. There are several grounds that legitimises that the contract is entered into without a competitive procedure. In the existing contract with GE, which was part of the procurement documents in the procedure that led to procurement of the existing screening apparatuses, it is stated that additional deliveries can be ordered from Helse Bergen. In any case, Helse Bergen considers the amendment of the contract to include the new equipment to be a lawful and immaterial change of the existing contract.
