With reference to your tender for a framework agreement for trade services.
Unfortunately the competition must be cancelled.
The justifiable reason is as follows:
The award criteria were unclear and unpredicatable and not appropriate to decide the competition.
The award criteria that will be used are respectively houry rate, material mark-up and environment.
The following weighting will be used:
— Hourly rate: 70 %.
— Normal time from summoning to when the work is started: 30 %.
Re the hourly rate and material mark-up:
Prices consist of the hourly rate and material mark-up. Both parts are to be completed in the table below.
All costs shall be included in the hourly rate (for example necessary tools, call-out fees etc.) The material price is to be expressed as a mark-up on the wholesaler's price list.
The environment will not be considered in this model.
Under the price only hourly rates will be assessed in this model, not material mark-up.
In the notice point II.1.8) Sub contracts, we stated that the contract will not consist of sub contracts, which is contrary to what is stated in the tender documents.
These conditions alone would lead to a cancellation requirement and a notice for a new competition.
In the specifications and the requirements for the service provider, there are requirements that can exclude service providers, requirements which are not in accordance with the current laws and regulations and unclear requirements:
— The development classes are too strict for the purpose ("responsible applicant" and development class 2). Central certification and local certification would be sufficient here.
— Under construction/joiner there are requirements for ”… responsible for inspecting the execution”.
— The requirements for the security centre are too strict and limiting for the profession locks and fittings.
— 3 different requirements for response time are stated in the document.
— The tender form includes imprecise formulations, which as led to it being difficult to compare the tenders. (for example as regards response time).
Kongsvinger municipality apologises for this.
Kongsvinger municipality will, in the first half of August 2014, announce a new competition when this has been corrected.
Submitted documents will be returned so that they can be used in the new competition.
We emphasise that in the event of a cancellation and a new competition, tenderers will not be bound by their previous tenders.
